Welcome to twrk. These Terms of Service ("Terms") govern your access to and use of the twrk website, mobile applications, and related services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms.

If you do not agree, do not use the Platform.

This website and the related mobile application are owned and operated by twrk, inc., a Delaware C-Corporation. When you visit or use this website or our mobile application, you are automatically agreeing that your access to the site and your use of it are: subject to terms and conditions, subject to applicable laws, and undertaken at your own risk.

All content included on the site, such as text, graphics, logos, button icons, images, audio, data compilations, and software, is the property of twrk, inc. and is protected under the standard copyright laws and Digital Millennium Copyright Act.

The following are covered by this policy: twrk, Inc.’s name, short-name (“twrk”), logos, and any other twrk graphics, trademarks, registered trademarks, and/or trade dress, regardless of whether they appear with the ™ or ® symbol and regardless of whether “Inc.” is included. twrk trademarks or trade dress may not be used in connection with any product or service that is not twrk, Inc. or specifically approved in writing by the CEO of twrk, Inc.

All items shown on this site are not necessarily for purchase. If you contact us for any reason, please be patient with the response time.

twrk attempts to provide information that is as accurate as possible. Unfortunately, it is not possible to ensure that any website or mobile application is free of human and/or technical errors. If a product or service offered by twrk is not as described, your sole remedy is to contact us and provide details of the error so that we may attempt to remedy it. We may contact you in response to obtain any additional necessary information. We reserve the right to correct any errors or inaccuracies, including after an order has been submitted. Any corrective action does not equate to an admission of guilt or any other admission.

1. ELIGIBILITY

You must be at least 18 years old to use the Platform. By using twrk, you represent and warrant that you have the legal capacity to enter into a binding agreement.

2. DESCRIPTION OF SERVICES

twrk provides a platform that connects job seekers with employment opportunities, including tools that may use automated technologies to assist with job matching, resume generation, and application submission.

Consent to Data Collection and Use

By using the Platform, you expressly consent to the collection, use, processing, and sharing of your information as described in these Terms and the Privacy Policy, including for:

Job matching and recommendations
Resume and application generation
Automated application submission
Platform improvement and analytics

twrk does not guarantee the accuracy, completeness, or reliability of any job listings, employer information, or job descriptions.
twrk does not verify all employers or job postings.
twrk does not guarantee that any user will receive interviews, job offers, or employment through use of the Platform.
twrk does not guarantee the quality, suitability, or legality of any opportunity.

3. USER ACCOUNTS

You agree to:

Provide accurate and complete information
Maintain the confidentiality of your account credentials
Be responsible for all activity under your account

We reserve the right to suspend or terminate accounts at our sole discretion.

4. USER CONDUCT

You agree not to:

Submit false, misleading, or fraudulent information
Impersonate any person or entity
Use the Platform for unlawful purposes
Interfere with or disrupt the Platform
Scrape, copy, or misuse data without authorization

5. CONTENT, DATA, AND INTELLECTUAL PROPERTY

User Content

You retain ownership of any content you submit, but grant twrk a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, and display such content in connection with providing and improving the Platform.

AI-Generated Content

Subject to applicable law, and as between you and twrk:

You own the final outputs (e.g., resumes, cover letters) generated for you using the Platform
twrk retains ownership of all underlying technology, models, algorithms, and improvements
twrk may use anonymized and aggregated data to improve its systems

You acknowledge that similar or identical outputs may be generated for other users.

Platform Content

All intellectual property on the Platform belongs to twrk or its licensors and may not be used without permission.

6. AUTOMATED SERVICES, AUTO-APPLY CONSENT, AND AI DISCLAIMER, AUTO-APPLY CONSENT, AND AI DISCLAIMER

The Platform may use automated systems, including artificial intelligence, to:

Generate resumes or application materials
Match users with job opportunities
Submit applications on behalf of users ("Auto-Apply")

Auto-Apply Consent

By enabling or using Auto-Apply features, you expressly authorize twrk to:

Submit job applications on your behalf
Transmit your profile, resume, and related data to third parties
Modify application materials for formatting or optimization purposes

You acknowledge and agree that:

You are solely responsible for reviewing your profile and materials prior to enabling Auto-Apply
Applications may be submitted without additional review at the time of submission
twrk does not guarantee accuracy, appropriateness, or success of any application

Liability Carveouts (Automation)

To the maximum extent permitted by law, twrk shall not be liable for:

Applications submitted through Auto-Apply
Errors, omissions, or inaccuracies in submitted materials
Any consequences arising from automated submissions, including employer responses or lack thereof

AI Disclaimer

You further acknowledge and agree that:

Outputs may be inaccurate, incomplete, or inappropriate
You are solely responsible for reviewing all content that you provide to twrk
twrk is not responsible for errors or consequences resulting from automated actions

7. NO EMPLOYMENT GUARANTEE

You expressly acknowledge that:

twrk is not an employer, recruiter, or staffing agency
twrk does not guarantee employment outcomes
twrk does not guarantee interviews, callbacks, or job offers
Your success depends on numerous factors outside twrk's control

8. THIRD-PARTY SERVICES

The Platform may integrate with third-party services (e.g., LinkedIn). twrk is not responsible for third-party content, policies, or actions.

9. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
ACCURACY OR RELIABILITY OF INFORMATION

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

twrk SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
twrk'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU (IF ANY) IN THE PAST 12 MONTHS

This includes damages related to:

Job search outcomes
Missed opportunities
Reliance on job listings or matches

11. INDEMNIFICATION

You agree to indemnify and hold harmless twrk, its officers, employees, and affiliates from any claims, damages, or expenses arising from:

Your use of the Platform
Your violation of these Terms
Your content or actions

12. TERMINATION

We may suspend or terminate your access at any time, with or without notice, for any reason.

13. PRIVACY

Your use of the Platform is also governed by our Privacy Policy.

14. GOVERNING LAW

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

15. DISPUTE RESOLUTION

Any disputes shall be resolved through binding arbitration administered by JAMS in the State of California, and venue shall be exclusively in California, except where prohibited by law.

Arbitration Procedure

Choosing an arbitrator:

Arbitration shall be conducted under JAMS Comprehensive Arbitration Rules
JAMS shall provide a list of 3 potential arbitrators
Each party shall have twenty (20) days from service of the list to strike one arbitrator
The remaining arbitrator shall be the official arbitrator to oversee and render decisions/opinions about any/all disputes

Waiver of Jury Trial and Class Actions

You waive any right to a jury trial and any right to participate in class actions or representative proceedings.

Exceptions

Either party may seek injunctive or equitable relief in a court of competent jurisdiction for intellectual property or misuse-related claims.

Any disputes shall be resolved through binding arbitration in California, except where prohibited by law.

You waive any right to participate in class actions.

16. CHANGES TO TERMS, PRIVACY POLICY, AND PLATFORM

twrk reserves the right, at its sole discretion, to modify, update, or replace these Terms, the Privacy Policy, the AI Disclosure, and any aspect of the Platform at any time.

Notice of Changes

We may provide notice of changes by:

Posting updated Terms on the Platform
Updating the "Effective Date" at the top of this document
Sending email notifications
Providing in-app notifications or alerts
Any other reasonable means of communication

You are responsible for reviewing these Terms periodically.

Effective Date

Changes will become effective as of the updated "Effective Date" unless otherwise specified.

Acceptance of Changes

Your continued access to or use of the Platform after any changes become effective constitutes your binding acceptance of the revised Terms, Privacy Policy, and AI Disclosure.

If you do not agree to the updated terms, you must immediately stop using the Platform.

Platform Modifications

twrk may modify, suspend, or discontinue any part of the Platform, including features, functionality, or availability, at any time without liability.

18. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and twrk regarding use of the Platform.

19. SEVERABILITY

If any provision is found unenforceable, the remaining provisions will remain in effect.

20. NO WAIVER

Failure to enforce any provision shall not constitute a waiver.

21. ELECTRONIC COMMUNICATIONS

You consent to receive communications electronically.

BY USING TWRK, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO THESE TERMS.

AI DISCLOSURE & ACCEPTABLE USE POLICY

1. AI DISCLOSURE

The Platform uses artificial intelligence and automated systems ("AI Systems"), including but not limited to Twrky, for:

Job matching
Resume and content generation
Application automation
User assistance

You acknowledge:

AI outputs may be inaccurate, incomplete, biased, or misleading
AI is not a substitute for professional advice
You are solely responsible for reviewing and verifying all information that you are submitting to tw

2. NO RELIANCE

You agree not to rely on AI-generated outputs as the sole basis for decisions, including career, financial, or legal decisions.

3. PROHIBITED USES

You agree not to use the Platform, including Twrky or any AI Systems, to:

Engage in illegal, fraudulent, or criminal activity
Generate or request instructions for wrongdoing (e.g., building weapons, committing crimes)
Harass, abuse, or harm others
Create or distribute harmful, offensive, or inappropriate content
Attempt to bypass safety controls or manipulate AI behavior
Use the Platform for purposes unrelated to job searching, hiring, or professional development
Extract, scrape, or reverse engineer AI systems

Any such use may result in immediate suspension or termination and potential legal action.

4. SAFETY AND ENFORCEMENT

twrk reserves the right to:

Monitor usage for abuse or violations
Remove content
Suspend or terminate accounts
Report unlawful activity to authorities

5. LIMITATION OF LIABILITY (AI)

To the maximum extent permitted by law, twrk shall not be liable for any damages arising from:

AI-generated content
Automated application submissions
Errors, omissions, or inaccuracies in outputs

EMPLOYER / RECRUITER TERMS

The following additional terms apply to employers, recruiters, and any entity using twrk to source, evaluate, or hire candidates ("Employers").

1. EMPLOYER RESPONSIBILITIES

Employers agree to:

Provide accurate, lawful, and non-misleading job descriptions
Comply with all applicable employment laws and regulations
Maintain appropriate hiring practices, including non-discrimination

2. NO GUARANTEE OF CANDIDATES

twrk does not guarantee:

Candidate quality, qualifications, or accuracy
That candidates are actively seeking employment
That any candidate will accept an offer

Employers are solely responsible for evaluating candidates.

3. DATA USE RESTRICTIONS

Employers agree:

To use candidate data solely for legitimate hiring purposes
Not to sell, share, or misuse candidate information
Not to scrape or export data outside permitted use

4. PLATFORM ROLE DISCLAIMER

twrk is not a recruiter, employer, or agent of either party. We act solely as a technology platform.

5. MATCHING AND SCORING DISCLAIMER

Any match scores, rankings, or recommendations are generated algorithmically and:

May be inaccurate or incomplete
Should not be solely relied upon
Do not constitute endorsements or guarantees

6. INDEMNIFICATION (EMPLOYERS)

Employers agree to indemnify and hold harmless twrk from claims arising out of:

Hiring decisions
Job postings
Violations of employment law

7. TERMINATION

twrk reserves the right to suspend or terminate Employer access at any time.

BY USING TWRK, YOU ACKNOWLEDGE AND ACCEPT THIS PRIVACY POLICY, AI DISCLOSURE, AND ALL TERMS ABOVE.

AI GENERATION

1. AI-Generated Content

Certain features of the Services generate resumes, cover letters, and other materials using artificial intelligence (“AI”). These outputs are generated automatically based on information you provide and other data sources.
You acknowledge and agree that:
AI-generated content may contain errors, omissions, inaccuracies, or outdated information, including so-called “hallucinations” where the AI produces incorrect or fabricated content;
Outputs may not reflect your actual experience, qualifications, or intent;
AI-generated content is provided for informational and drafting purposes only and does not constitute professional, legal, or career advice;
You are solely responsible for reviewing, editing, and verifying all content that you submit to twrk, which twrk may use in order to create and/or submit information on your behalf.
We do not guarantee that any AI-generated content will be accurate, complete, reliable, or suitable for any particular purpose, including securing employment.

2. Disclaimer of Warranties

THE SERVICES, INCLUDING ALL AI-GENERATED CONTENT, ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
ANY WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, OR USEFULNESS OF AI-GENERATED CONTENT;
ANY WARRANTIES THAT THE SERVICES WILL BE ERROR-FREE OR THAT DEFECTS WILL BE CORRECTED.
WITHOUT LIMITING THE FOREGOING, WE MAKE NO REPRESENTATIONS OR WARRANTIES THAT ANY RESUME, COVER LETTER, OR OTHER MATERIAL GENERATED THROUGH THE SERVICES WILL BE FREE FROM ERRORS, INCLUDING AI HALLUCINATIONS, OR WILL RESULT IN JOB INTERVIEWS, OFFERS, OR EMPLOYMENT.

3. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL [COMPANY NAME] BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
LOSS OF EMPLOYMENT OPPORTUNITIES;
FAILURE TO OBTAIN INTERVIEWS OR JOB OFFERS;
DAMAGE TO REPUTATION;
RELIANCE ON INACCURATE OR AI-GENERATED CONTENT;
ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR ANY CONTENT GENERATED THROUGH THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID (IF ANY) TO USE THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

4. User Responsibilities Section

You are solely responsible for:
Reviewing, editing, and verifying all content that you submit to twrk, which twrk may use in order to create and/or submit information on your behalf;
Ensuring that all information that you submit to twrk is accurate, truthful, and not misleading; and
Complying with all applicable laws, regulations, and employer requirements.
Any consequences arising from your use of AI-generated content, including submission to employers.
AI-generated content may contain errors. twrk’s content, whether presented to the user and/or created for the user, was generated (at least in part) using AI and may contain inaccuracies or hallucinations. By using twrk’s Platform/Services, you consent to twrk using and creating such AI-related content, and you specifically consent to and desire for twrk to submit job applications on your behalf using such technology without your review and/or edits, regardless of whether such applications contain errors.
You agree not to rely on the Services as a substitute for your own judgment or professional advice.
