TWRK, INC. BETA USER AGREEMENT

Effective Date: April 15, 2026

This Beta User Agreement (“Agreement”) is entered into by and between twrk, Inc. (“twrk,” “we,” “us,” or “our”) and the individual participating in the Beta Program (“Beta Tester,” “you,” or “your”).

By accessing or using the Platform, you agree to be bound by this Agreement.

1. PURPOSE OF BETA PROGRAM

The Platform is a pre-release, experimental product designed to assist job seekers using automation and artificial intelligence, including but not limited to generating application materials and submitting job applications.

You acknowledge:

  • The Platform is incomplete and subject to change

  • Features may be inaccurate, unstable, or non-functional

  • twrk may modify, suspend, or discontinue the Platform at any time

2. VOLUNTARY PARTICIPATION; NO COMPENSATION

Your participation is:

  • Voluntary

  • Unpaid

  • Provided in exchange solely for early access

You agree:

  • You are not an employee, contractor, or agent

  • You are not entitled to compensation, equity, or benefits

3. NO EMPLOYMENT RELATIONSHIP

Nothing in this Agreement creates:

  • Employment

  • Partnership

  • Joint venture

  • Agency

4. AI-GENERATED CONTENT DISCLOSURE

The Platform may use artificial intelligence and large language models (“LLMs”) to generate:

  • Resumes

  • Cover letters

  • Responses to application questions

  • Other employment-related content

You acknowledge and agree:

  • AI-generated content may be:

    • Inaccurate

    • Incomplete

    • Misleading

    • Fabricated (“hallucinated”)

  • twrk does not verify the accuracy of generated content

  • You are solely responsible for reviewing, editing, and verifying all content that you submit to twrk, which twrk may use in order to create and/or submit information on your behalf

  • AI-generated content may contain errors. twrk’s content, whether presented to the user and/or created for the user, was generated (at least in part) using AI and may contain inaccuracies or hallucinations. By using twrk’s Platform/Services, you consent to twrk using and creating such AI-related content, and you specifically consent to and desire for twrk to submit job applications on your behalf using such technology without your review and/or edits, regardless of whether such applications contain errors

5. AUTO-APPLY & USER AUTHORIZATION

5.1 Authorization to Act on Your Behalf

By using the Platform, you expressly authorize twrk to:

  • Submit job applications on your behalf

  • Transmit your information to third parties

  • Interact with job listings, employer systems, and application portals

5.2 User Responsibility

You represent and warrant that:

  • All information you provide is true, accurate, and not misleading

  • You have the right to submit all materials used

  • You have reviewed, edited, and verified all content that you submit to twrk, which twrk may use in order to create and/or submit information on your behalf (where applicable)

5.3 No Guarantee of Control

You acknowledge that:

  • Automated submissions may occur without real-time review

  • You may not be able to approve each individual application before submission

  • twrk does not guarantee the ability to recall, edit, or withdraw submitted applications

6. THIRD-PARTY PLATFORMS & INTEGRATIONS

The Platform may interact with or rely on third-party services, including but not limited to:

  • Job boards

  • Employer applicant tracking systems (ATS)

  • LinkedIn or similar platforms

You acknowledge:

  • twrk is not affiliated with or endorsed by such third parties (unless explicitly stated)

  • Your use may be subject to third-party terms and policies

  • Automated activity may:

    • Violate third-party terms of service

    • Trigger account restrictions or bans

You assume all risks associated with such interactions.

7. NO GUARANTEE OF RESULTS

twrk makes no guarantees regarding:

  • Job matches

  • Interviews

  • Employer responses

  • Employment outcomes

The Platform is a tool, not a placement service.

8. REAL JOB POSTINGS DISCLAIMER

To twrk’s knowledge, job postings may be real and active, but:

  • twrk does not verify all listings

  • Listings may be:

    • Expired

    • Fraudulent

    • Inaccurate

You are responsible for independently evaluating opportunities.

9. USER CONDUCT & PROHIBITED USES

You agree not to:

  • Use the Platform to submit false or misleading information

  • Impersonate another person

  • Misrepresent qualifications, experience, or identity

  • Use the Platform in violation of any law or third-party terms

twrk reserves the right to suspend or terminate access for violations.

10. FEEDBACK & INTELLECTUAL PROPERTY

10.1 Feedback Ownership

All Feedback you provide is:

  • Voluntary

  • Non-confidential

  • Owned exclusively by twrk

10.2 Assignment

You irrevocably assign all rights in Feedback to twrk.

10.3 Platform Ownership

All Platform-related IP, including:

  • Features

  • Algorithms

  • AI outputs (to the extent permitted by law)

  • Improvements

are owned solely by twrk.

11. DATA, PRIVACY, AND CONSENT

By using the Platform, you consent to:

  • Collection and use of your data

  • Transmission of your data to third parties

  • Processing of your data by AI systems

… subject to twrk’s Privacy Policy.

12. CONFIDENTIALITY

You agree not to:

  • Share non-public features or functionality

  • Publicly disclose details of the Platform

  • Reverse engineer or attempt to extract underlying systems

13. NO WARRANTY

THE PLATFORM IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, INCLUDING:

  • Accuracy of AI outputs

  • Success of job applications

  • System reliability

14. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

twrk shall not be liable for:

  • AI-generated inaccuracies or misrepresentations

  • Job application outcomes

  • Third-party platform actions (including bans or penalties)

  • Any indirect or consequential damages

Total liability: $0

15. INDEMNIFICATION

You agree to indemnify and hold harmless twrk from claims arising out of:

  • Your use of the Platform

  • AI-generated content submitted on your behalf

  • Violations of third-party terms

  • Misrepresentations in job applications

16. TERMINATION

twrk may terminate access at any time, for any reason.

17. BETA PERIOD

  • Duration is undefined

  • Access may be revoked at any time

  • No guarantee of continued availability

18. GOVERNING LAW

This Agreement shall be governed by the laws of the State of Delaware; venue would lie in California. Any/all disputes are subject to arbitration according to twrk’s Terms of Service.

19. ENTIRE AGREEMENT

This Agreement, along with the Terms of Service and Privacy Policy, constitutes the entire agreement.

20. ACCEPTANCE

By using the Platform, you:

  • Acknowledge and accept all risks

  • Agree to be bound by this Agreement
